Conflicto de competencia suscitado entre los Juzgados Sexto Civil Municipal y el Séptimo Administrativo del Circuito de Pereira.
En este caso el despacho con categoría municipal tomó las reglas de reparto contenidas en el Decreto 1382 de 2000, compiladas en el Decreto 1069 de 2015, para declararse incompetente y no pronunciarse de fondo.
Considera la Corte que con esta actuación se afecta la celeridad y eficacia en la administración de justicia, así como la protección a los derechos fundamentales del accionante.
Se resuelve el caso con la remisión del expediente al Juzgado Sexto Civil Municipal de Pereira, para que de manera inmediata tramite y adopte la decisión de fondo a que haya lugar.
Se hace una advertencia a esta autoridad para que en lo sucesivo se abstenga de proceder como lo hizo, en tanto ello desconoce la jurisprudencia de la Corporación.

- Sexto. Civil Municipal de Pereira dentro del expediente ICC-3219.
- SEGUNDO. REMITIR al Juzgado
- Sexto. Civil Municipal de Pereira el expediente ICC-3219 para que, de manera inmediata, tramite y adopte la decisión de fondo a que haya lugar dentro de la acción de tutela interpuesta por Luis Carlos Marín Bohórquez contra la Alcaldía Municipal de Marsella y la Secretaría de Salud Departamental de Risaralda.
- TERCERO. ADVERTIR al Juzgado
- Sexto. Civil Municipal de Pereira, para que en lo sucesivo se abstenga de proceder como lo hizo, en tanto ello desconoce la jurisprudencia de la Corte Constitucional.
